TERMS AND CONDITIONS FOR CUSTOMERS

These Terms and Conditions (“Terms”) govern access to and use of the services, applications, website, technology infrastructure, and digital marketplace platform operated by YourSeyva Skills India Tech Pvt Ltd, having its registered office at 2nd Floor, Kalleshwara Enterprises, Vinayaka Nagar, Anekal, Karnataka – 562106 (hereinafter referred to as “YourSeyva”, “YS”, “Company”, “we”, “our”, or “us”).

These Terms apply to all users, customers, visitors, consumers, account holders, and any persons accessing or using the YourSeyva platform (“Customer”, “User”, “you”, or “your”).

By accessing the Platform, creating an account, booking services, communicating with service providers, or using any services available through the Platform, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and all related policies, disclaimers, guidelines, safety instructions, and supplemental terms issued by YourSeyva from time to time.

1. NATURE OF PLATFORM

1.1 YourSeyva is solely a technology-enabled discovery, listing, aggregation, and connecting platform that enables customers to connect with independent third-party service providers.

1.2 YourSeyva does not directly provide home services, labour services, repair services, consultancy services, technical services, professional services, or any other physical services listed on the Platform unless expressly specified otherwise.

1.3 All service providers listed on the Platform are independent third parties and are not employees, agents, partners, representatives, contractors, or affiliates of YourSeyva.

1.4 YourSeyva merely facilitates digital interactions between customers and service providers and shall not be considered a party to the actual service agreement between them.

1.5 All negotiations, pricing discussions, service execution, timelines, warranties, assurances, and post-service obligations are solely between the customer and the service provider.

2. CUSTOMER ELIGIBILITY

2.1 By using the Platform, you represent and warrant that:

* you are legally competent to enter into binding agreements;

* all information provided by you is true, complete, and accurate;

* you shall use the Platform only for lawful purposes;

* you shall not misuse the Platform or engage in fraudulent activities.

2.2 You shall maintain the confidentiality of your account credentials and remain responsible for activities conducted through your account.

3. CUSTOMER RESPONSIBILITIES

3.1 Customers shall:

* provide accurate service location details;

* communicate respectfully with service providers;

* provide safe access to premises wherever applicable;

* disclose relevant risks, hazards, or conditions before the commencement of services;

* cooperate reasonably during service execution.

3.2 Customers shall not:

* abuse, threaten, harass, intimidate, or assault service providers;

* discriminate against service providers;

* engage in unlawful activities through the Platform;

* misuse emergency or urgent service requests;

* make false complaints or fraudulent refund claims.

3.3 Customers acknowledge that service providers may independently assess the feasibility and safety of work before accepting or continuing services.

4. SERVICE BOOKINGS AND PRICING

4.1 YourSeyva may display indicative visitation charges, facilitation charges, inspection charges, onboarding charges, or platform charges.

4.2 Certain service categories may involve nominal platform-associated charges such as:

* ₹15 for selected non-contact or basic facilitation-based services;

* ₹150 for selected contact-based or monitored services.

4.3 Such charges are indicative and may vary depending on:

* service category;

* urgency;

* complexity;

* duration;

* manpower involved;

* tools or equipment required;

* distance and location.

4.4 Final service pricing, labour charges, material costs, transportation charges, emergency fees, and additional work charges shall be independently discussed and agreed upon between the customer and the service provider.

4.5 YourSeyva does not guarantee fixed pricing, pricing uniformity, service availability, timelines, or specific outcomes.

4.6 Payments made directly to service providers shall remain transactions solely between the customer and the service provider unless processed through an official YourSeyva payment system.

5. DISCLAIMER OF LIABILITY

5.1 YourSeyva acts solely as a connecting and facilitation platform.

5.2 YourSeyva shall not be responsible or liable for:

* acts or omissions of service providers;

* quality of services;

* delays or cancellations;

* misconduct;

* negligence;

* accidents or injuries;

* property damage;

* theft or criminal acts;

* pricing disputes;

* payment disputes;

* warranty disputes;

* unsatisfactory service outcomes;

* emotional distress;

* indirect or consequential damages.

5.3 Customers engage service providers entirely at their own discretion and risk.

5.4 YourSeyva does not independently verify all claims, skills, qualifications, licences, certifications, or representations made by service providers.

5.5 YourSeyva shall not guarantee:

* uninterrupted access to the Platform;

* service availability;

* provider responsiveness;

* successful completion of services;

* customer satisfaction.

6. SAFETY, RECORDING, AND MONITORING

6.1 Certain services may involve operational monitoring systems, including:

* body cameras;

* digital logs;

* GPS tracking;

* communication recording;

* verification systems;

* safety monitoring protocols.

6.2 Such mechanisms are implemented solely for transparency, accountability, operational efficiency, and security purposes.

6.3 Customers acknowledge and consent to reasonable safety and monitoring procedures associated with Platform operations.

7. REFUND, CANCELLATION, AND RESCHEDULING

7.1 Refunds, cancellations, rescheduling requests, platform charges, and payment-related matters shall be governed by separate policies issued by YourSeyva from time to time.

7.2 Customers are advised to review such policies before booking services.

8. SUSPENSION AND TERMINATION

8.1 YourSeyva reserves the right to suspend, restrict, or terminate customer access to the Platform without prior notice in cases involving:

* fraud;

* abuse;

* harassment;

* misuse of services;

* repeated false complaints;

* violation of laws;

* violation of these Terms;

* safety concerns;

* reputational risks to the Platform.

9. INTELLECTUAL PROPERTY

All trademarks, logos, software systems, technology infrastructure, designs, branding elements, applications, and content associated with YourSeyva shall remain the exclusive property of YourSeyva Skills India Tech Pvt Ltd.

10. INDEMNITY

Customers agree to indemnify and hold harmless YourSeyva, its directors, officers, employees, affiliates, shareholders, and representatives against any claims, liabilities, damages, losses, proceedings, penalties, costs, or expenses arising from:

* misuse of the Platform;

* violation of these Terms;

* unlawful conduct;

* disputes with service providers;

* property damage;

* injuries;

* false representations;

* fraudulent activities.

11. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by the laws of India.

All disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts situated in Bengaluru, Karnataka.

12. MISCELLANEOUS

12.1 YourSeyva reserves the right to amend these Terms at any time without prior notice.

12.2 Continued use of the Platform after updates constitutes acceptance of the revised Terms.

12.3 If any provision is held invalid or unenforceable, the remaining provisions shall continue to remain valid and enforceable.

12.4 These Terms constitute the complete understanding between the parties regarding the use of the Platform.

By accessing and using the YourSeyva Platform, you acknowledge that you have read, understood, and voluntarily agreed to these Terms and Conditions.
